Welcome to martinakocianova.com. These Terms & Conditions govern your use of this website and any purchases made through it. By accessing this website or placing an order, you agree to be bound by these Terms.
1. About Us
This website is operated by Martina Kocianova.

2. Products
Every piece of jewellery is individually handcrafted using natural gemstones, precious metals, and traditional craftsmanship.
Due to the handmade nature of our work:
- Each piece is unique.
- Natural gemstones may contain inclusions, colour variations, and markings that are part of their natural character and are not considered defects.
- Product photographs are provided for illustration purposes. Colours may vary slightly depending on screen settings.
⸻
3. Pricing
All prices displayed on the website are shown in the applicable currency and are inclusive or exclusive of taxes as indicated at checkout.
Worldwide shipping is provided free of charge unless otherwise stated.
The prices of precious metals, gemstones and other materials fluctuate over time. As a result, the prices of our jewellery may be updated periodically and may increase or decrease without prior notice. Any confirmed order will always be honoured at the price displayed at the time the order is placed.
Where possible, we aim to arrange shipments in a way that minimises additional import duties and taxes for our customers. However, any customs duties, import taxes or local fees imposed by the destination country remain the responsibility of the recipient unless otherwise agreed in writing.
While every effort is made to ensure that product descriptions and pricing are accurate, Martina Kocianova reserves the right to correct any typographical errors, inaccuracies or omissions and to cancel or refuse any order affected by an obvious pricing or listing error. In such cases, any payment received will be refunded in full.
⸻
4. Orders & Production
Submitting an order does not automatically constitute acceptance. Once your order has been received, we will review it and confirm its acceptance by email.
As a small independent studio, the majority of our jewellery is handcrafted to order. Unless otherwise stated on the product page, production typically takes approximately 8–9 weeks before dispatch. Some pieces are available for immediate shipment and will be dispatched sooner. Please refer to the individual product page for the estimated lead time of each piece.
Following your order, we will confirm the estimated production and dispatch timeframe. In rare cases, production may take longer if particularly rare or unique gemstones or materials need to be sourced. Should this occur, we will notify you as soon as possible.
If you require your order by a specific date, please contact us before placing your order. While we will always do our best to accommodate urgent requests, production times cannot be guaranteed.
We reserve the right to:
- refuse or cancel any order;
- limit quantities;
- request additional verification before dispatch.
If payment has already been received for a cancelled order, a full refund will be issued.
⸻
5. Payment
Payments are processed securely through our authorised third-party payment providers.
We do not store or have access to your full payment card details.
Orders will only enter production or be dispatched once full payment has been successfully received, unless otherwise agreed in writing (for example, bespoke commissions requiring a deposit).
All payments must be made in the currency displayed at checkout.
In the event that a payment is declined, reversed or suspected to be fraudulent, Martina Kocianova reserves the right to suspend, cancel or refuse the order until payment has been successfully verified.
⸻
6. Handmade & Made-to-Order Pieces
Every piece of jewellery is individually handcrafted by Martina Kocianova or in close collaboration with highly skilled master craftspeople, using natural gemstones, precious metals and traditional techniques.
Many pieces are made to order specifically for each client. Estimated production times are provided on the relevant product page and are intended as a guide only. Production schedules may occasionally vary depending on workshop capacity, material availability or the sourcing of rare gemstones.
Because every piece is handmade, slight variations in colour, texture, stone pattern, dimensions or finish are a natural part of the making process. These variations are not considered defects but are part of the individuality and authenticity of each piece.
Where natural gemstones are used, every stone is unique and may display natural inclusions, colour variations and other naturally occurring characteristics that distinguish it from the photographs shown on the website.
No two pieces are ever exactly alike, making every creation a unique work of wearable art. These natural variations are an essential part of the beauty, authenticity and craftsmanship that define Martina Kocianova’s work.
⸻
7. Custom Orders
All bespoke, made-to-order and personalised commissions require a non refundable deposit, typically between one-third (33%) and one-half (50%) of the total purchase price, depending on the complexity of the commission and the value of the materials required.
Production will only commence once the deposit has been received and the design has been approved by the client.
As each custom piece is created specifically for the client, deposits are non-refundable once work has commenced, except where required by applicable law.
The remaining balance is due upon completion of the piece and prior to shipping or collection.
If the completed piece is not paid for in full or collected within 90 days of the client being notified that it is ready multiple times, and no alternative arrangement has been agreed in writing, Martina Kocianova reserves the right to cancel the order, retain the deposit to cover materials and labour, and resell, redesign, or otherwise dispose of the piece without further obligation to the client.
⸻
8. Shipping
Free shipping worldwide.
Estimated delivery times are provided as guidance only and cannot be guaranteed.
We are not responsible for delays caused by customs authorities, courier services, weather events, strikes, natural disasters, war, armed conflict, terrorism, government restrictions, sanctions, border closures, pandemics, or any other circumstances beyond our reasonable control.
Where possible, we aim to ship orders using services that minimise additional import duties and taxes for our customers. However, any customs duties, import taxes or local fees imposed by the destination country remain the responsibility of the recipient unless otherwise agreed in writing.
We take great care in packaging and dispatching every order. While parcels being permanently lost in transit are exceptionally rare, in the unlikely event that a parcel is confirmed by the shipping carrier as lost in transit, Martina Kocianova will work closely with the customer to resolve the matter.
Once the shipping carrier has completed its investigation and confirmed that the parcel has been lost, we will, where reasonably possible, recreate the piece and arrange for its delivery. If recreating the piece is not reasonably possible due to the unique nature of the materials or design, an alternative solution will be agreed with the customer at our discretion.
Claims relating to lost parcels will be considered only after the shipping carrier has completed its investigation and officially confirmed that the parcel has been lost.
9. Risk & Ownership
Ownership of the jewellery transfers to the customer only once full payment has been received.
Risk in the jewellery passes to the customer upon successful delivery to the shipping address provided at the time of purchase.
Customers are responsible for ensuring that the shipping address provided is accurate and complete. Martina Kocianova cannot be held responsible for delays, loss or additional shipping costs resulting from incorrect or incomplete delivery information supplied by the customer.
Please provide a valid telephone number when placing your order. Shipping carriers often require a contact number for delivery updates, customs processing or to arrange successful delivery. If a telephone number is not provided during checkout, Martina Kocianova may contact you to request one before dispatching your order.
Your telephone number and any personal information provided for shipping purposes will be used solely for processing and delivering your order and will not be used for any other purpose except where necessary to facilitate the shipment of your order.
⸻
10. Returns & Exchanges
Items may be returned within 30 days of delivery, provided they are returned in their original, unworn and unused condition, together with all original packaging, certificates and accompanying materials.
To be eligible for a refund or exchange, returned items must:
- be unworn and unused;
- be free from damage, alterations or signs of wear;
- be returned in their original packaging with all certificates and accompanying materials.
Custom-made, bespoke, personalised or engraved pieces are not eligible for return or exchange unless they are found to be faulty or defective, or where required by applicable consumer law.
If you are purchasing as a consumer within the European Union, your statutory consumer rights remain unaffected. Certain products, including bespoke and personalised items, may be exempt from the statutory right of withdrawal in accordance with applicable law.
Return shipping costs are the responsibility of the customer unless the item received is faulty, damaged or incorrect.
Refunds will be processed within 7–10 business days after the returned item has been received, inspected and approved. Refunds will be issued using the original payment method.
Exchange requests must be made within the 30-day return period and are subject to product availability.
⸻
11. Repairs
Should your jewellery require repair or maintenance, please contact us at hello@martinakocianova.com before returning the piece.
If a manufacturing defect is identified, Martina Kocianova will cover the reasonable costs associated with the repair, including return shipping where applicable.
Repairs required as a result of accidental damage, misuse, improper care, impact, normal wear and tear, or unauthorised alterations are not covered and may incur a repair fee. Any repair costs will be discussed and agreed with the customer before work begins.
Please do not send jewellery for repair without contacting us first to receive shipping instructions.
Natural Materials
Every piece is handcrafted using natural gemstones and other natural materials. As a result, each piece is unique and may vary slightly from the photographs shown on the website.
Natural gemstones commonly contain inclusions, colour variations, internal markings and other naturally occurring characteristics. These are not considered defects or faults but are part of the unique beauty and individuality of each stone.
Because natural gemstones vary in hardness and durability, customers are encouraged to handle and wear their jewellery with care. Damage resulting from accidental impact, improper handling or normal wear is not considered a manufacturing defect.
⸻
12. Jewellery Care
Our jewellery is handcrafted using a variety of natural gemstones, minerals, pearls and precious metals, each with its own unique characteristics and care requirements. Please refer to Jewellery Section.
Jewellery should always be handled with care. Please avoid dropping or subjecting your jewellery to impact, as natural gemstones and carved mineral pieces may chip, crack or break if struck. Unless a piece is crafted exclusively from precious metal and durable gemstones such as diamonds, sapphires or rubies, we recommend wearing it with additional care and avoiding activities that may expose it to excessive impact or abrasion.
Avoid exposing your jewellery to harsh chemicals, perfumes, cosmetics, household cleaning products, chlorine, seawater and other substances that may damage natural stones, pearls or precious metals.
Every gemstone is different, and some precious stones are naturally softer or more delicate than others. These natural properties are not defects but characteristics of the material and should be respected when wearing and caring for your jewellery.
For detailed information on cleaning, storage and caring for your specific piece, please refer to our Jewellery Care Guide. If you are unsure how to care for your jewellery, please contact us at hello@martinakocianova.com before attempting to clean or repair it.
